Terms and Conditions

The Service:

AdFair, Mike Pollard & Associates and our Partners provide Internet server space for our members for a fee for the express purpose of providing http content to the general public. In addition to this, our members may also receive Internet mail after taking the steps to set up the mail boxes and forwarding accounts. Users are permitted to access their web space via FTP or FrontPage to upload files for their web sites. In addition to this we may from time to time offer other services that relate to the selling for Internet server space. These services may change from time to time.

Cost and Payment For Service:

Current pricing information may be obtained from our web site at http://www.AdFair.com. By accepting this agreement, you agree to pay the current rate for the service as indicated on the web site.

All hosting fees must be paid in full prior to your server being activated. When your annual agreement with us is about to expire, we will send you a renewal invoice by e-mail one month prior to the site's date of expiration.  This invoice must be paid prior to the site expiration date or we may, at our discretion, disable your site until payment is made.  If your site is disabled, there would be a $25 reconnect fee.  Any payment not honored by your bank would incur a $25 fee

Refunds:

AdFair offers no refunds once the account has been established and server space allocated for your domain.

Use of the service:

The use of any of our servers is to be bound by the terms of this agreement, the AdFair web site at http://www.AdFair.com, and other information that is made available to you.

You may not, in the use of the service, break any state local or federal laws. You agree that AdFair may remove any information that it finds to be unlawful. You also understand that AdFair may terminate your account if it feels that your information is unlawful. You may not in anyway send unsolicited bulk e-mail, post to news groups in ways that does not conform with the rules of that group that can be traced back to our network, your web site or you. By doing so you automatically terminate your service with AdFair. You may not display content from your web site promoting SPAM, bulk e-mail or illegal web sites or illegal activities.

Availability of the service:

The Internet is a complex network of equipment and for that reason the service may not be available to you at all times. AdFair will do everything in it's power to maintain availability however a certain amount of down time can be expected. In no way shall AdFair, Mike Pollard & Associates or our Partners be held liable for any interruption in service for any cause. Should you not be able to reach you site please contact us at support@adfair.com to report the problem. We will repair the problem as soon as possible.

Changes:

The agreement and the service may change from time to time. Changes will be posted at www.adfair.com or on this page 30 days before you will be bound by the new terms.

Termination:

Both AdFair and you have the right to terminate your service at the end of any contractual period by providing written notice via e-mail For the purposes of this Agreement and since all accounts are paid on an annual basis, the contractual period is defined as the annual expiration date of your site.

Legal Action:

AdFair cannot be held liable for any content posted by clients, or any damages you, your business or any other entity suffer as a result of downtime or termination of your account. Any legal action must be taken in the Canyon County, in the State of Idaho in the country of the United States.
